On December 22, Roskomnadzor notified the cryptocurrency exchanger aggregator Bestchange.ru about the exclusion of its website from the list of prohibited ones, a service representative told topplabs.org. The meeting of the Arkhangelsk Regional Court, at which the decision of the first instance court to block it, was held on November 25. A month later, access to the site was fully restored.
Valeria Smirnova, a representative of the law firm Digital Rights Center (DRC), which represents Bestchange.ru in unlocking cases, explained that this is the third such lawsuit and all of them were eventually canceled due to the inconsistency of the charges.
“In each case, the court and the administrative plaintiff change, but the legal basis for blocking remains unchanged: firstly, the plaintiff states that cryptocurrency is a monetary surrogate, and monetary surrogates are prohibited in accordance with the Federal Law“ On the Central Bank of the Russian Federation (Bank of Russia) ” … Secondly, that the turnover of cryptocurrency has no legal regulation, is outside the control of the state and, therefore, has a potential danger, "Smirnova explained.
Next week, January 1, 2021, the law regulating digital financial assets and digital currencies comes into force. In July, the document was signed by Russian President Vladimir Putin. The new rules introduce a definition of cryptocurrencies and prohibit their use as a means of payment.
